The NSA has been tracking millions of phone company customers so the chances are yes they have been tracking your calls. Three of the biggest phone companies (at&t, verizon and bellsouth) have all been 'co-operating' with the NSA......for a fee. the only 'major' player in the telecommunications industry to not go along was Qwest. They asked that the matter be taken up with FISA (Foreign Intelligence Security Act) Court. The NSA refused claiming that "they didn't want to do that because FISA might not agree with them." Qwest also got a similar answer when they asked for a letter from the attorney general saying it was legal.
Can you sue your phone company over this? Very doubtful but technically possible. Section 222 of the communications act prohibits the telephone companies from divulging any information about your calling habits. Including who you call and the routes that those calls (the carriers that transmit the call) take to get to there final destination. The penalties that can be handed down by the FCC for violating section 222 can be as high as $130,000 per day with a cap of $1.325 million per violation.....The FCC could class each persons record as one violation or there whole customer base as one violation there is no set in stone rule of what 'one violation' is in the FCC's eyes but it would be expensive.
but to sue your local telephone company would take more money than you or I have. plus you would have to gain access to what I am sure has now become 'classified in national security interests' documents. The best thing you can do is write your senator and congressman and ask them to ask questions about this. If enough people harrass each politician they may just get worried enough about there seats to tuyrn around and stand upto Bush and demand he stops allowing these invasions into privacy and breaking of laws by goverment agencies.
